Overview

Welcome to CTS - Car Tuning Star. "CTS", "we", "us" and "our" refer to STAR CAR TUNING LLC, a Texas limited liability company doing business as CTS - Car Tuning Star. CTS operates this store and website, including all related information, content, tools, products and services (the "Services"). The store is powered by Shopify.

These Terms of Service, together with the policies they reference (the "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully: they include our limited warranty and limitations of liability.

By visiting, using or buying through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Access and account

By agreeing to these Terms you represent that you are of legal age in your state or country. To buy, we may ask for your email, phone and billing, payment and shipping details; you represent they are accurate and complete. You are responsible for the security of your account and all activity under it. You may not transfer or sell your account.

2. Our products

We describe our products as accurately as we can. Colors or appearance may vary with your screen. We may change descriptions, discontinue products or limit quantities per person or region.

CTS harnesses and bench cables are technical products for technicians and shops. They must be installed by qualified people following the instructions. Before buying, confirm compatibility with us (free on WhatsApp) using the cab year, the engine and the ECM label.

Our products are not designed to modify, disable or remove emissions control systems. The buyer is responsible for installing and using the products in compliance with all applicable federal, state and local laws, including emissions and vehicle safety laws.

CTS is an independent manufacturer. Third-party brands (Detroit Diesel, Freightliner, Cummins and others) are mentioned only to show compatibility; CTS is not affiliated with or authorized by them.

3. Orders

When you place an order, you make an offer to purchase. CTS may accept or decline it at its discretion; an order is accepted once we receive payment and confirm it. If we decline, change or cancel an order, we will contact you at the email or phone you provided and refund what was charged.

Exchanges and warranty are governed solely by our Exchange and Warranty Policy.

You may buy for your own use, for your shop, or for resale. If you export the products, you are responsible for complying with the laws of the destination country, except for what CTS expressly handles in duties-prepaid (DDP) shipments.

4. Prices and payment

Prices, discounts and promotions may change without notice. You are charged the price in effect when you place the order, as shown in your confirmation. Unless stated otherwise, prices do not include taxes or import charges, except on DDP shipments. You represent that you are authorized to use the payment method and will pay the charges for your purchase.

5. Shipping and delivery

Delivery times are carrier estimates and are not guaranteed. Shipping terms are in our Shipping Policy. Risk of loss or damage passes to you when the carrier delivers the order to the address you provided. If a package arrives damaged, let us know within 48 hours with photos.

6. Intellectual property

The content of the Services (text, photos, videos, diagrams, guides, designs and trademarks) belongs to CTS or its licensors and is protected by intellectual property laws. You may not copy, distribute or publish it without our written permission. CTS names and logos are trademarks of CTS. Shopify's and other third parties' names are trademarks of their owners.

7. CTS Academy courses

Courses are educational and taught live on Zoom unless stated otherwise. Enrollment is personal and non-refundable. If CTS changes a date or cancels a course, we refund 100%. Recordings are available for the period stated on the course page and are for your personal use only; they may not be shared or published. No modified calibration files are shared in the courses.

8. Third-party tools and links

The Services may include third-party tools or links we do not control. You use them at your own risk and under those third parties' terms. We are not responsible for their products, content or practices.

9. Relationship with Shopify

CTS - Car Tuning Star is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with CTS - Car Tuning Star. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and CTS - Car Tuning Star, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with CTS - Car Tuning Star.

10. Privacy

Personal information we collect is governed by our Privacy Policy, and some may be subject to Shopify's Privacy Policy. Information you submit is transmitted to Shopify and to third parties that may be located in other countries in order to provide the Services.

11. Feedback and content you submit

If you send us comments, reviews, photos or suggestions, you grant us a free, worldwide, perpetual license to use, publish and adapt them, including for commercial purposes. You represent that you have the right to submit them and that they do not infringe third-party rights. We may moderate or remove content at our discretion.

12. Errors and inaccuracies

There may be errors in descriptions, prices, availability or shipping times. We may correct them and update information, or cancel an order affected by an error, even after it is placed; in that case we refund what was charged.

13. Prohibited uses

You may use the Services for lawful purposes only. You may not use them to break laws or third-party rights, harass, send false information or spam, impersonate others, upload malicious code, collect other people's personal data, or circumvent the site's security measures. You also may not copy or resell parts of the website or bulk-extract its content. Software agents may use the Services only under Section 14. We may suspend or terminate your access if you breach these Terms.

14. Agents

14.1 This section applies if you use or allow an Agent to access the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, without direct supervision.

14.2 No Agent may access the Services unless it identifies itself at all times and complies with Section 14.4. No Agent may access the Services if we have asked it not to.

14.3 We may limit, including by technical measures, how any Agent accesses the Services.

14.4 Agents must: (i) identify themselves in every HTTP/HTTPS request by including "Agent/[agent name]" in the user agent string; (ii) not conceal that they are an Agent, for example by mimicking human behavior or completing or circumventing CAPTCHAs; (iii) respond truthfully when asked whether they are a human or a computer; and (iv) not circumvent measures that limit or control Agent access.

15. Termination

We may terminate this agreement or your access to the Services at any time. You remain liable for amounts due up to that date. Sections that by their nature should survive (intellectual property, warranty, limitation of liability, indemnification, governing law and privacy) continue to apply.

16. Warranty and disclaimer

Our products carry the limited warranty described in our Exchange and Warranty Policy: "Works or we replace it" for 30 days when the failure is CTS's responsibility (exchange, not refund) and 12 months against manufacturing defects. That is CTS's only express warranty.

Outside that warranty, and to the extent permitted by law, the Services and site information are provided "as is" and "as available". Implied warranties that cannot be excluded by law, such as merchantability or fitness for a particular purpose, are limited to 12 months from the ship date. Technical information, guides and courses are general and educational; they do not replace a qualified technician's judgment on each vehicle. Some jurisdictions do not allow these limitations, so they may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, neither CTS nor its members, managers, employees, affiliates, agents, contractors, suppliers or licensors, nor Shopify and its affiliates, will be liable for indirect, incidental, special, punitive or consequential damages, including lost profits, lost revenue, vehicle downtime, loss of data, or towing or labor costs, arising from the use of the Services or the products, even if advised of their possibility. In no event will CTS's total liability for an order exceed the amount you paid for that order.

18. Indemnification

You agree to indemnify and hold harmless CTS, Shopify and their affiliates, members, managers, employees, agents, contractors, licensors and suppliers from third-party claims, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law or third-party rights, or the installation or use of the products.

19. Severability

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the extent permitted and the rest will remain in effect.

20. Waiver and entire agreement

Our failure to enforce a right is not a waiver of it. These Terms and the policies posted on the site are the entire agreement between you and CTS regarding the Services and supersede any prior agreements.

21. Assignment

You may not assign these Terms without our written consent. CTS may assign them without notice.

22. Governing law

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law. Any dispute will be resolved in the state or federal courts located in Harris County, Texas, and you and CTS consent to that jurisdiction.

23. Headings

Headings are for convenience only and do not limit or affect these Terms.

24. Changes to these Terms

You can always review the current version on this page. We may update these Terms by posting changes on the site; material changes will be notified as required by law. Your continued use of the Services after a change means you accept it.
